The status of SNCBs is a topic that has been hotly debated for more than 30 years. This is partly because they cannot be exported from one Member Sttate to another, and partly because their place within the landscape of European social security coordination has always been questionable
The webinar offered a deep dive into the history and development of SNCB’s: the relevance and raison d’être of SNCB; the role off Member States, the CJEU and the EU legislator in the development and fine-tuning the concept of SNCB’s. The principle of non-exportability and very few limited exceptions were explained. There was room for reflection on how to overcome the distinction between social assistance and SNCB schemes. Finally, the question was raised whether or not the non-exportability of SNCB’s discriminates against disabled people and is possibly contrary to the EU’s fundamental principles and international obligations?
