Social rights for cross-border workers and their family members

The seminar was organised by MoveS in collaboration with its Luxembourgish national expert Nicole Kerschen. MoveS is an EC-funded network of independent experts from 32 European countries coordinated by Eftheia and Deloitte.

In Luxembourg, cross-border workers represent almost half of domestic salaried
employment. Thanks to European law, they enjoy the same social rights as resident workers. This seminar reviewed the recent case law of the European Court of Justice relating to Luxembourg's legislation on (i) Financial aid for students and children of frontier workers (ii) Family allowances for the children of the spouse or partner of frontier workers (iii) Survivor's pensions for the partner of a frontier worker, whose civil partnership registered abroad, and the impact this case law has had on Luxembourg law and practice.
In addition, since the end of the Covid-19 epidemic, new rules have applied to cross-border telework, both from the point of view of social security and tax law. The second objective of the seminar was to open a wide-ranging debate on Luxembourg's specific features, practices and problems encountered by the various players.
